Secretary of Justice vs. Hon. Ralph C. Lantion, G.R. No. 139465, 18 January 2000 (Philippines)

Respondent was indicted in the United States for multiple charges. The Note Verbale issued by the United States District Court, a request for extradition and other supporting documents, was received by the Philippines' Department of Justice. Respondent requested for copies of these documents which was denied by the Philippines' Secretary of Justice. The denial was based on the Extradition Treaty between the Philippines and United States which provides that it is only after the filing of the petition for extradition when the person sought to be extradited will be furnished by the court with copies of the petition, request and extradition documents.
