The Supreme Court ruled that there is no conflict between the international law and national law. Instead, the law is silent as to the rights of a potential extraditee to notice and hearing prior to the judicial determination of the propriety of extradition. In this case, the Supreme Court applied the rules of fair play. It stated that application of the basic twin due process rights of notice and hearing will not go against the treaty or the implementing law. Considering that Respondent is faced with a clear and present danger of liberty and forcible banishment to a foreign land, the Supreme Court upheld the Respondent's due process rights and ordered the Secretary of Justice to furnish Respondent with copies of the extradition request and supporting papers, as well as time to file his comment with supporting evidence.
