The Implementing Rules and Regulations (IRR) enunciate the State's policy to protect forest resources through sustainable forest management by the adoption of an aggressive forest protection program to eliminate illegal logging. The IRR apply and cover the purchase, manufacture, ownership, possession, sale, transfer, importation and use of chainsaws.

The Republic of of Indonesia, through the named Petitioners, entered into a Memorandum of Agreement with Respondent James Vinzon, sole proprietor of Vinzon Trade and Services for the maintenance of equipment at the Embassy of Indonesia in the Philippines and the official residence of the Indonesian Ambassador. The Memorandum of Agreement was thereafter terminated by the subsequent Chief of Administration allegedly due to the unsatisfactory work of Respondent. Respondent filed a complaint against Petitioners.

The Environment Management and Conservation Act provides for the conservation, sustainable development and management of the environment of Vanuatu. The Act establishes the Environmental Registry, and the Biodiversity Advisory Council. It directs the preparation of the National State of the Environment report, and such policies and plans determined to be necessary by the Minister.

The Forestry Act provides for the protection, development and sustainable management of forests and the regulation of the forestry industry in Vanuatu. The Act covers planning for the forestry sector, the requirements for carrying out commercial forestry operations on any land, protection of the forest environment, reforestation and export of timber.

Gerald Perera was arrested by the police, subjected to torture, suffered acute renal failure and other serious injuries and subsequently hospitalized. Respondents argued, among others, that Perera's claim for reimbursement of hospital expenses was exorbitant and he should have just sought treatment from a government hospital. The court recognized the right of everyone “to the enjoyment of the highest attainable standard of physical and mental health.”
