Decree-Law No. 12/2005, Administrative Offences under the Legal Regime of Public Procurement and the Legal Regime of Public Contracts (Timor-Leste)

The Decree-Law states that acts or omissions which are contrary to the rules in the Legal Regime of Public Procurement, special legal regimes related to the same and in the Legal Regime of Public Contracts, as well as additional standards relating thereto, are considered as administrative offenses. 

The Decree-Law provides for the measures and penalties as well as the procedures for the imposition of the same, over public officials and tenderers who are found to have violated the applicable laws. These measures include disciplinary measures, disqualification and ineligibility of the tenderer, or suspension of the public procurement procedures, among others. It also provides the procedure for appealing any decision to impose the foregoing measures.
