The case involves a murder charge where the law regarding qisas is clarified. Qisas is defined by Section 299 of the Pakistan Penal Code (PPC) as punishment causing similar hurt at the same part of the body of the convict as has caused to the victim or by causing his death if he has committed qatl-i-amd (murder), in exercise of the right of the victim or wali (person entitled to claim qisas). According to the court, Section 311 of the PPC (punishment rendered by court after waiver or compounding of qisas) applies only to murders liable to qisas punishment. It also clarified that three categories of offenders mentioned in Section 306 of the PPC can be punished if the murder is liable to qisas, otherwise they are liable under Section 302(b) of the PPC.
