Wilfredo A. Ruiz vs. AAA*, G.R. No. 231619, 15 November 2021 (Philippines)

The Supreme Court held that the grant of support and all other reliefs in a permanent protection order prevent further acts of violence against the victim, safeguard them from harm, minimize disruptions in their lives and help them regain control over their lives.

The reliefs granted under the Permanent Protection Order (PPO) do not depend on the subsistence of the marriage. The determining factor in granting the relief is whether the offended party was subjected to physical, sexual, psychological or economic abuse. Under the Anti-Violence Against Women and Children Act, even if the charge against a respondent has been dismissed, a PPO shall still be granted as long as there is clear showing that the act from which the order might arise exists.
