Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990, Republic Act No. 06969 (Philippines)

The Act requires that the manufacturer, importer or processor of any new chemical substance or mixture shall submit the information required and enumerated therein to the Department of Environment and Natural Resources, as well as any test data related to the health and environmental effects of such substance or mixture. Testing of chemicals is required when there is a reason to believe that it will pose unreasonable risk to the health or the environment, or there is insufficient data to determine the effects of the chemical to health and the environment, among others. The Act also enumerated the chemical substances which are exempt from the pre-manufacture notification. The public shall have access to the records and information pertaining to the chemical substances or mixtures (safety data submitted, data on emission or discharge into the environment, etc.) The Act further enumerates the prohibited acts and provides the penalties therefor.
