Sale of Goods Act (Brunei Darussalam)

The Sale of Goods Act of Brunei governs contracts or purported contracts for the sale of goods. The Act provides for the formation of contracts, including the definition of a contract of sale, its formalities, subject matter and price. The Act further provides for the effects of the contract, such as the transfer of the property, the timing for the transfer of the property and the transfer of title. It also contains provisions on the duties of the seller and buyer, including delivery and payment of the goods. It also has specific provisions on delivery, such as the consequences of delivering the wrong quantity of goods and installment deliveries. Furthermore, it provides for the rights of unpaid sellers which include a seller's lien, right of stoppage in transit and right of re-sale. The Act likewise provides for actions for breach of contract.
