Rules of Procedure for Environmental Cases, Supreme Court Administrative Matter No. 09-6-8-SC (Philippines)

The Rules of Procedure govern civil, criminal, and special civil actions brought before the identified courts involving the enforcement or violations of environmental, and other related laws, rules, and regulations. An Environmental Protection Order may be issued if it appears that the issuance thereof is a matter of extreme urgency and the applicant will suffer grave injustice and irreparable injury, which is effective for 72 hours. The Writ of Kalikasan is a remedy available to persons, on behalf of others, whose constitutional right to a balanced and healthful ecology is violated, or is threatened to be violated by a public official or private individual which involves environmental damage of great magnitude. A writ of continuing mandamus is a remedy for an aggrieved party when the government neglects to perform an act which it is duty-bound to perform with respect to the enforcement or violation of an environmental law, or unlawfully excludes the enjoyment of environmental rights.
