Revised Rules of Practice and Procedure of the Energy Regulatory Commission (ERC), ERC Resolution No. 01, Series of 2021 (Philippines)

The Resolution prescribes and defined the procedures for all proceedings before the Energy Regulatory Commission. Particularly, it laid down the procedure and rules on formal requirements, motion for confidential treatment of information, pleadings, pre-filing requirements, filing of petitions for intervention, opposition and comment, service and filing of pleadings, motions, provisional authority and interim reliefs, discovery procedures, and rules on evidence, among others. It also prescribes the procedure for pre-trial conferences, summary proceedings, and hearings. 

The Resolution also provides the special procedures to follow in particular proceedings such as applications for revision of rates, application for approval of power supply contract between a distribution utility and a new power provider, applications for approval of capital expenditure, and consumer complaints.
