Prescribing the General Policies for the Implementation of the Retail Competition and Open Access, Department of Energy Department Circular No. 2012-05-0005 (Philippines)

The Circular allows Contestable Customers to choose their source of electricity, either from a Generation Company, supplier, or an affiliate of a Distribution Utility (DU) which constituted itself as a Supplier or the supply business of a DU within its franchise area. The foregoing suppliers must be duly licensed with the Energy Regulatory Commission. The DU, which has a franchise over the area of the Contestable Customer, will act as a Supplier of Last Resort upon the occurrence of a Last Resort Supply Event as defined under the Circular.
