People of the Philippines vs. Cielito Orita, G.R. No. 88724

In a landmark ruling, the Supreme Court declared that once the offender has carnal knowledge of his victim, all essential elements for the crime have been accomplished and the crime of rape has already been consummated. The Supreme Court likewise ruled that perfect penetration is not essential for rape to be consummated. The entry of the male organ into the labia or lips of the female organ, even without rupture of the hymen or laceration of the vagina, is sufficient for conviction for the crime of rape.
