Ozone Layer Protection Act, No. 27 of 2010 (Vanuatu)

The Act controls ozone depleting substances in Vanuatu in accordance with the obligations under the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol. 

The objectives of this Act are to: 

  1. Protect human health and the environment from adverse effects resulting or likely to result from human activities which modify or are likely to modify the ozone layer.
  2. Phase out ozone depleting substances as soon as possible except for essential uses.
  3. Give effect to the Vanuatu’s obligations under the Convention for the Protection of the Ozone Layer and the Montreal Protocol on Substances that Deplete the Ozone Layer. 

The Act specifically mandates the application of the precautionary principle by those who have responsibilities, functions and powers under the Act. The Act prohibits and restricts the importation of controlled substances and certain goods listed in the Act and its schedules. It further provides for permitting, registration and licensing of controlled substances.
