The National Green Tribunal Act (India)

The Act provides for the establishment of a National Green Tribunal. The Tribunal shall dispose of cases relating to environmental protection and conservation of forests and other natural resources including enforcement of any legal right relating to the environment. The Tribunal shall have jurisdiction over all civil cases where a substantial question relating to the environment is involved and such question arises out of the implementation of the environmental enactment specified in the schedule. The Tribunal is empowered to provide relief and compensation to the victims of pollution and environmental damage, restitution of property damaged and restitution of the environment. The Act also provides for relief or compensation in case of death or injury of any person or damage to any property or environment resulting from an accident of the adverse impact of an activity or operation. The Act further provides that failure to comply with an order or award or decision of the Tribunal shall be punishable with imprisonment for a term of three years or fine or both.
