Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity

The Nagoya Protocol to the Convention on Biological Diversity has the objective of a fair and equitable sharing of benefits arising from the utilization of genetic resources, including by appropriate access to genetic resources and by appropriate transfer of relevant technologies. The Protocol applies to genetic resources within the scope of Article 15 of the Convention, to traditional knowledge associated with genetic resources within the scope of the Convention, as well as to the benefits from the utilization of such resources and knowledge. In order to achieve fair and equitable sharing of benefits arising from utilization of genetic resources, parties shall take legislative, administrative or policy measures as appropriate. Legislative, administrative or policy measure shall also be taken to ensure that benefits arising from utilization of genetic resources held by indigenous and local communities are shared in a fair and equitable manner with the communities concerned, based on mutually agreed terms.
