Muhammad Abbas vs. The State, Jail Petition No. 499 of 2015 (Pakistan)

The petitioner is accused of killing his wife. The crime was witnessed by the wife's brother and a neighbor. The petitioner, in his defense, said that the killing was committed in the name of Ghairat (honor). He contended that the deceased was a woman of bad character and the petitioner, having seen her in the company of a man, was under grave and sudden provocation and had shot her once, meriting a lesser sentence. The court rejected the position of the petitioner, citing the 2005 amendment to the Pakistan Penal Code which specifically provides that a killing committed in the name or on the pretext of honor does not fall within the provision imposing a lesser sentence.
