Mst Mahar Angiza v. Bakhti Raja, 2014 MLD 962 (Pakistan)

The plaintiff filed a suit against her brothers to the effect that she is the legal sharer in a parcel of land, being the legal heir of her father. As such, the defendants have no right to deny or interfere in her share and should be restrained from alienating/transferring the same. She prayed for possession of the property to the extent of her share. The defendants opposed, claiming that their sister had already received her hereditary share in the form of cash from one of her brothers. The court held that the allegation that the plaintiff was paid must be proven. However, the alleged sale was not proven through cogent and reliable evidence.
