Mst Beena vs. Raja Muhammad and Others , PLD 2020 Supreme Court 508 (Pakistan)

The case involved the custody over a minor, whereby in the agreement for khula (divorce), the wife gave up custody of their minor son. The Family Judge, ruling in favor of the husband, used such pejorative terms against the wife such as "crippled disabled lady with [zero] source of income." The Supreme Court held that neither the mother's physical condition nor her income is determinative in a custody case. Such pejorative words seriously offend the right to be a person thereby infringing constitutional guarantees like the right to life, the right to human dignity and the right to non-discrimination of persons with disabilities, thereby violating the constitution.
