Merchant Shipping Act (Brunei Darussalam)

The Merchant Shipping Act of Brunei provides for the registration of every Brunei ship in order to be recognized as such. A Brunei ship must have a certificate of registry, which must be produced if required. The Act also provides for the requirements and manner of transfer and transmission of a Brunei ship, as well as for their mortgage. The Act further provides for the rules as to the name of a ship, including any change of name and re-registration of abandoned ships. It also empowers the Minister of Communications to make regulations for Brunei ships, and imposes the penalty of forfeiture upon any person who uses the Brunei flag and assumes Brunei national character on board a ship owned in whole or in part by a person not qualified to own a Brunei ship. The Act likewise contains provisions on masters and seamen, including their qualifications, engagements, wages and discharge. It further provides for control and licensing of ships.
