Mandating Alternative Dispute Resolution in all Contracts Involving Public-Private Partnership Projects, Build-Operate and Transfer Projects, Joint Venture Agreements Between the Government and Private Entities, Executive Order No. 78 (Philippines)

All contracts involving Public-Private Partnership projects and/or those entered into under the Build-Operate and Transfer Law, and Joint Venture Agreements between the government and private entities issued by the National Economic Development Authority shall include provisions on the use of Alternative Dispute Resolution (ADR) mechanisms, at the option and upon agreement of the parties to the foregoing contracts. Further, all parties who enter into similar contracts with Local Government Units are also encouraged to include ADR mechanisms in these contracts.
