Law No. 6/2021 of 31 March, Approving the Legal Regime on Voluntary Arbitration and the First Amendment to the Civil Procedure Code (Timor-Leste)

The Voluntary Arbitration Law (VAL) applies to both domestic and international voluntary arbitrations that take place in Timor-Leste, the execution of provisional measures, national arbitral awards, and confirmation and execution of foreign arbitral awards. Arbitration agreements are required to be in writing. Judicial courts are generally not allowed to intervene in matters covered by voluntary arbitration.

The VAL provides for the constitution of the arbitral tribunal, as well as the duties, responsibilities and rights of the arbitrators. The arbitral tribunal is empowered to issue provisional measures, provided that the requirements and procedures for the issuance thereof are observed. It further provides for the procedure in the enforcement of domestic arbitral awards, as well as the confirmation and enforcement of foreign arbitral awards.
