JG vs. Jabatan Pendaftaran Negara [2005] 4 CLJ 710 (Malaysia)

The case involves the official recognition of the gender identity of a transgender person. The applicant sought to make amendments in the National Registry to reflect the applicant's gender identity. The court recognized that there are four determinants of gender, namely, chromosomal factor, gonadal factor, genital factor and psychological factor. The presumption regarding gender needs to be corrected because the psychological factor could not be considered at birth, as it is not yet manifested, but it may become an overriding consideration subsequently as the individual develops.
