Islam-Ud-Din v. Noor Jehan, 2016 SCMR 986 (Pakistan)

The case involved the inheritance of three brothers and a sister from their deceased father. The brothers claimed that certain properties had been gifted to them by their father while he was alive. The court found that the document whereby the father allegedly gave the properties to the sons was purportedly signed in the presence of three witnesses. However, only one was produced as a witness in the case. Thus, the document should be considered not proven. The court thus awarded the rightful share of the sister, although she had already passed away. The share was awarded to her heirs who were joined in the proceedings.
