The Supreme Court discussed the precautionary principle which applies when there is a lack of full scientific certainty in establishing a causal link between human activity and environmental effect, the constitutional right of the people to a balanced and healthful ecology shall be given the benefit of the doubt. It applied the precautionary principle to the case by stating that all three (3) conditions--uncertainty, the possibility of irreversible harm and the possibility of serious harm--are present in the case.
The Supreme Court stated that there exists a preponderance of evidence that the release of Genetically Modified Organisms into the environment threatens to damage the ecosystem, not only to the field trial sites, but to the health of the people once the bioengineered eggplants are consumed as food.
