Implementing Rules and Regulations of the Alternative Dispute Resolution Act of 2004, Republic of the Philippines Department of Justice Department Circular No. 098, Series of 2009
The Circular established the Office for Alternative Dispute Resolution (OADR) as an attached agency of the Department of Justice vested with powers to act as appointing authority of mediators and arbitrators and is mandated to promote and develop the use of Alternative Dispute Resolution in public and private sectors. It provides for the rules on selection of a mediator, the ethical conducts which a mediator should observe, an enumeration of the roles of parties and their counsel, procedure for the conduct of mediation and arbitral proceedings, and the composition and jurisdiction of the arbitral tribunal. It also provides for the rules and regulations in the recognition an enforcement of foreign and domestic arbitral awards, and states which rules and regulations govern early neutral evaluation, mini-trials and mediation-arbitrations.
