Government Procurement Reform Act, Republic Act No. 9184 (Philippines)

The Act requires that all procurement by the government must be within the approved budget of the procuring entity and shall be done via competitive bidding. It defines the functions of the Bids and Awards Committee, and lays down the process for competitive bidding. The head of a government agency may declare a failure of bidding or shall not award a contract if there is prima facie evidence of collusion between the public officers and any of the bidders. The Act also provides for alternative modes of procurement when prevailing circumstances warrant the same, in order to promote economy and efficiency. The Act also established the Government Procurement Policy Board for its effective implementation.
