Foreign Investment Act 2020 (Tonga
The Act permits an overseas person to carry on any business activity in Tonga subject to compliance with the laws of Tonga.
The Act also defines the list of business activities which are reserved exclusively for domestic investors or the reserved list, and those which may be carried on by an overseas person provided that such person satisfies the prescribed conditions for carrying on those activities or the restricted list. It also requires that a valid foreign investment registration certificate be obtained before any overseas person can commence carrying on a business activity in Tonga, as well as the procedure for application therefor.
