Fawad Ishaq and Mst. Kurshida Ishaq v. Mst. Mehreen Mansoor, PLD 2020 269 (Pakistan)

Mst. Kurshida is the owner of a house and lot. When her son got married, the marriage contract stated that the house and lot shall be given to their daughter-in-law as dowry. Mst. Kurshida did not sign the marriage contract, only her husband did. Subsequently, the daughter-in-law filed suit against her father-in-law and mother-in-law, claiming the property as part of her dowry. The court held that the property could not be gifted as dower as Mst. Kurshida was not a signatory to the marriage contract. Neither did she grant her husband a power of attorney. Therefore, the husband could not effect transactions over her property.
