Environmental Protection Act, 2008 (Tuvalu)

The Act provides for the protection and management of the environment in Tuvalu, among other purposes. The objectives of the Act include:

  • Coordinating the role of government in relation to environmental protection and sustainable development. 
  • Providing a mechanism for the development of environmental policy and law.
  • Promoting a clean and healthy environment for all Tuvaluans.
  • Preventing, controlling, monitoring, and responding to pollution.
  • Promoting public awareness and involvement in environmental issues and the preservation of Iloga (identity) as it relates to the environment.
  • Facilitating compliance and implementation of obligations under any regional and international environmental or natural resource agreements or conventions to which the Government of Tuvalu has ratified or acceded to, among others. 

The Act provides for the appointment of Enforcement Offices who shall have the power to enter any land or building, dwelling, vessels, ships, aircraft, vehicles and other forms of conveyance for the purpose of monitoring the impact of any activity, matter or thing relating to the environment, investigating the commission of any offence or the breach of any lawful obligation under a law relating to the protection or management of the environment, enforcing this Act or any other law relating to the protection or management of the environment. Such Environment Officer shall also have the power to issue Precautionary Notices, and Notices to Cease Activity in case immediate threat or risk to environment.
