Environmental Management and Conservation (Amendment) Act, No. 28 of 2010 (Vanuatu)

The Act amends the Environmental Management and Conservation Act with the amendments set out in its schedule. The amendments include the substitution of the title with "Environmental Protection and Conservation Act." It provides an additional section directing all persons and agencies having responsibilities under the Act or whose functions may relate to the environment to apply the precautionary principle. It further amends the section requiring a preliminary Environmental Impact Assessment (EIA) to determine whether a project has significant environmental, social or custom impacts, requiring instead a preliminary environmental assessment to screen the application and determine if there is a need for an EIA. It also modifies the provision on penalties for offenses, increasing the penalty for individual offenders and indicating specific penalties for a corporate offender, an individual who has previously committed the offense, and a corporate offender who has previously committed the offense.
