Environmental Conservation Rules, 2014 (Myanmar)

The Environmental Conservation Rules of Myanmar provide for powers and duties of the Ministry of Environmental Conservation and Forestry (Ministry) and the Environmental Conservation Department (Department). The Rules mandate the preparation of necessary policies relating to environmental conservation for each sector. They identify the requirements and procedures for conducting an Environmental Impact Assessment (EIA). The Rules provide that the categories of project, business, service or activity that shall conduct EIA shall be determined by the Ministry. The Ministry may assign the Department to scrutinize the report of environmental impact assessment prepared and submitted by a third party or an organization and report to the Ministry through the environmental impact assessment Review Body. The Ministry may also approve the EIA report or environmental management plan with the guidance of the Committee. The Rules also provide that the Ministry shall determine and declare the categories of activities which may cause an impact on the environmental quality with the approval of the Committee and with the agreement of the Union Government. Such businesses shall then obtain Prior Permission from the Ministry. Finally, they specify certain prohibitions against hazardous waste disposal and activities which are damaging to the ecosystem and natural environment.
