Electronic Transactions Act (Papua New Guinea)

The Act defines data message as to include electronic data interchange, electronic communication, electronic mail, telegram, telex or telecopy. Where the law requires information to be in writing and provides consequences if it is not, such requirement is met by a data message if the information contained in it is accessible so as to be usable for subsequent reference. 

It provides the rules on retention of electronic records or data messages, attribution of data messages and acknowledgment of receipt of data messages, among others. Where the law requires the signature of a person or party in relation to electronic record or data message, such requirement of the law is satisfied if an electronic signature is used. It also provides for the obligations of the signatory and trust service provider with respect to electronic signatures and the legal recognition of electronic transferable records.
