Electronic Communication Abuse Offences Act 2020 (Tonga)

It shall be prohibited to, with intent or with reckless disregard, abuse another person using an electronic communication and as a result, cause harm to that person or any other person. 

The Act defines serious offences including the use or attempt to use a service to post electronic communication, if such person does the same so that the electronic communication be bullying, menacing, harassing or harmful to another and posting the electronic communication would be bullying, menacing, harassing or harmful to a reasonable person in the other person's position. The Act provides that an action for statutory tort may be filed by the person harmed. The person harmed who has also filed a criminal complaint in relation to the alleged offense may also request for a stop publication order and a disabling order. 

The Act also enumerates and defines the obligations of service provider which include that it shall do its best to prevent communication networks and facilities from being used in or in relation to the commission of offenses under the Act.
