Electricity Act 2010 (Samoa)

The Electricity Act 2010 of Samoa provides for the appointment of a Regulator who shall mainly be responsible for the proper and effective administration of this Act and for providing advice to the Minister and to Cabinet on matters of electricity policy, among other functions provided in the Act. The Act also provides that the Regulator may issue two types of licenses, namely, electricity network service licenses, and generation licenses. The Act outlines the procedure for application and grant of the licenses, as well as the suspension and revocation thereof. The Regulator is further empowered to set, change and review tariffs charged by a licensee. The Act mandates that the Regulator must develop standards of electricity services necessary for the provision of reliable, efficient, and safe electricity supply, and quality of consumer service. The Regulator is likewise designated as the Government's representative responsible for resolving disputes between consumers and the electricity network service licensees. It also contains provisions on power system expansion planning, public input and consultation, dispute resolution and appeals.
