Electricity Act 2007 (Tonga)

The Electricity Commission (Commission) was established and mandated to implement the enforcement actions and regulations made under the Act, carry out activities for concession contracts and licensing of electricians, develop and recommend regulations for standards for electrical safety, as well as the powers for a concessionaire, among others. 

The Act prohibits the generation or sale of electricity except under the authority and subject to the provisions of a concession contract entered into with the Commission. The Act provides the procedure for the granting of concession contracts, requirements for concession contracts, and transfer of assets and liabilities. It further states that all equipment of any kind whatsoever imported into the Kingdom of Tonga by or on behalf of a concessionaire or a person carrying on an activity of generation, distribution and supply of electricity for the purpose of supplying electricity to a concessionaire, shall be free from all customs duties, excise duties and any other taxes imposed by any Act in relation to the importation of those goods.
