The Criminal Offences (Sentencing and Execution) Act, Act No. 38 of the year 2017 (2074) (Nepal)

The Act provides for the general principles for sentencing to be observed by the courts, including the requirement for a separate hearing post-conviction to determine the appropriate penalty to be imposed upon an offender. The Act enumerates the matters to be taken into account in determining the sentence of an offender, including children, grounds for determination of the sentence of fine and provides for circumstances when the penalty of imprisonment is appropriate.
