Criminal Miscellaneous Application No. 200 of 2019 in Criminal Appeal No. 238-L of 2013, PLD 2019 Supreme Court 527 (Pakistan)

In a prosecution for murder, two persons related to the deceased gave evidence that they were present at the scene of the crime and witnessed the same. The accused was accordingly convicted by the trial court. However, it was subsequently proven that the witnesses lied about being present at the scene. The issue thus arose whether the rule falsus in uno, falsus in omnibus (false in one thing, false in everything) should apply in courts in Pakistan. The court held that a judicial system which permits deliberate falsehood is doomed to fail and a society which tolerates it is destined to self-destruct. The court thus declared that the rule falsus in uno, falsus in omnibus shall henceforth be an integral part of  jurisprudence in criminal cases in Pakistan and the same shall be given effect to, followed and applied by all the courts in the country in its letter and spirit.
