The Constitution of the Republic of Myanmar, 2008

The fundamental law declares that the Republic of the Union of Myanmar is an independent sovereign nation. The Head of the Union and the Head of Executive of the Union is the President. The judicial power of the Union is shared among the Supreme Court, High Courts of the Regions, High Courts of the States and courts of different levels including Court of Self-Administered Areas. The legislative power is vested on the Pyidaungsu Hluttaw which is composed of the Pyithu Hluttaw with representatives elected on the basis of township and the Amyotha Hluttaw formed with representatives from Regions and States. 

The constitution of Myanmar recognizes the:

  • Rights of equality
  • Rights of liberty
  • Rights of justice
  • Protection from unjustified restraint
  • Rights of peasants
  • Rights of workers
  • Right to education
  • Right to work
  • Freedom of conscience and religion
  • Right to vote
  • Right to property
  • Right to human dignity
  • Protection from ex post facto laws

It also provides that the Union is the ultimate owner of all lands and all natural resources above and below the ground, above and beneath the water and in the atmosphere. The constitution likewise defines the State Structure, with the Union being constituted by seven Regions, seven States and the Union territories.
