Competition Order (Brunei Darussalam)

The Competition Order creates the Competition Commission of Brunei Darussalam (Commission). The Commission has the function, among others, of:

  • Enhancing efficient market conduct and promoting overall productivity.
  • Innovation and competitiveness of markets in Brunei.
  • Promoting and sustaining competition therein.
  • Promoting a strong competitive culture and environment throughout the economy.
  • To act as an advocate for competition matters.
  • To educate and promote the public understanding of the value of competition.
  • To advice the Government on national needs and policies on competition.
  • To act internationally as the national body representative of Brunei on competition matters. 

It prohibits agreements, decisions or concerted practices which have the effect of preventing, restricting or distorting competition. It likewise prohibits abuse of dominant position which is defined as: 

  1. Predatory behavior towards competitors.
  2. Limiting production, markets or technical development to the prejudice of consumers.
  3. Applying dissimilar conditions to equivalent transactions with other trading parties.
  4. Making the conclusion of contracts subject to acceptance by the other parties of supplementary obligation which have no connection to the subject of the contract. 

Furthermore, it prohibits mergers that have resulted, or may be expected to result, in a substantial lessening of competition within any market in Brunei Darussalam for goods or services.
