Code of Civil Procedure, No. 92/2015/ QH13, 2015 (Viet Nam)

The Code of Civil Procedure provides for the basic principles in civil proceedings. It covers the order and procedures for initiating lawsuits at People's Courts to settle civil lawsuits (e.g., civil, marriage and family, business, trade and labor lawsuits) and order and procedures to request the Court to settle civil matters. It also covers procedures for recognition and enforcement in Viet Nam civil judgments or decisions of foreign Courts, awards of foreign arbitrators, enforcement of civil judgments, tasks, entitlements and responsibilities of proceeding authorities/officers, rights and obligations of participants in procedures, of individuals, of regulatory agencies, people's armed units, and organizations, which ensure that the resolution of civil cases is carried out quickly, accurately, truthfully and lawfully. Specifically, among the cases falling within the court's jurisdiction are the disputes over property ownership and other rights over property; disputes over the development and utilization of water resources and waste discharge to water as prescribed in the law on water resources; disputes over land according to legislation on land; and disputes over the right to forest ownership/enjoyment according to regulations in the law on forest protection and development.
