Circular on Awarding Renewable Energy Contracts and Developer Registration, DOE Department Circular No. DC 2009-07-0011 of 2009 (Philippines)

The Circular provides the guidelines on awarding of Renewable Energy Service/Operating Contracts (RE Contracts) covering both the pre-development and development stages either for power or non-power applications. The Circular defines an RE Contract as a service agreement between the Government and an RE Developer in which the latter shall have the exclusive right to explore, develop or utilize a particular RE area. The RE Contract shall be divided in the Pre-Development Stage and the Development/Commercial Stage. The Circular provides for the conversion of the RE Contract and application requirements. RE Contracts shall be awarded through an open and competitive process of selection or by direct negotiation, the procedures for which are provided in the circular. The Circular also provides the salient provisions which shall be included in the RE Contract.
