Boracay Foundation vs. Province of Aklan, G.R. No. 196870, 26 June 2012 (Philippines)

The Supreme Court held that the Environmental Impact Assessment submitted by the Province of Aklan failed to include a thorough study on the impact of the construction of new buildings on the reclaimed land and the surrounding areas. Particularly, such study is even more imperative due to the significant contributions of Boracay's white sand beach to the country's tourism trade. It also emphasized the duty of the national government agencies to secure prior public consultation and approval of the local government units in the maintenance of ecological balance. Thus, the Supreme Court issued a writ of continuing mandamus to order the Department of Environment and Natural Resources to review the impact of the reclamation project to the environment based on updated and comprehensive studies.
