Anti-Online Sexual Abuse or Exploitation of Children and Anti-Child Sexual Abuse or Exploitation Materials Act, Republic Act No. 11930 (Philippines)

The Act enumerates the unlawful or prohibited acts, whether done through online or offline means, and regardless of the consent of the child. These prohibited acts include:

  • Coercing or extorting children to create or produce any form of Online Sexual Abuse or Exploitation of Children and Child Abuse or Exploitation Material (CSAEM)
  • To livestream acts of child sexual abuse or exploitation
  • To publish any form of CSAEM
  • To sell or distribute CSAEM by any means, among others

The Act expressly allows law enforcement agencies to inquire into and/or examine any particular deposit or investment, upon order of a competent court, if it is established that there is reasonable ground to believe that deposits or investments are related to violations of the Act. If the offender is a foreigner, the foreigner will be immediately criminally prosecuted. After serving the imposed sentence, the foreigner shall be deported and permanently barred from re-entering the Philippines. 

The Act further includes the mandatory services to be provided to victims of child sexual abuse or exploitation and their families, including:

  • Emergency shelter or appropriate housing
  • Counseling
  • Free legal services
  • Medical or psychological services
  • Livelihood and skills training
  • Educational assistance
