Anti-Corruption Commissioner Act (Tonga)

The Act states that the Anti-Corruption Commissioner (Commissioner) shall direct its attention to serious and systematic corrupt conduct and take into account the responsibility and role of other public authorities and public officials in the prevention of corrupt conduct. It defines the functions and powers of the Commissioner. 

The Act also laid down the rules and procedure for investigations, compulsory examination and inquiries, search warrants, disposal of property, and protection of witnesses. It also defined the punishable acts which constitute offenses such as:

  • Obstruction
  • Providing false and misleading evidence
  • Procuring false testimony
  • Bribery of a witness
  • Prevention of a witness from attending, among others
