Amendments to the Mechanism Supporting the Development of Wind Power Projects, PM Decision No. 39/2018/QD-TTg, 2018 (Viet Nam)

The issuance amends and supplements prior issuances on the development of wind power projects in Viet Nam. It distinguishes between an onshore wind power project and an offshore wind power project, with the latter being constructed and operated outside the mean low water mark. The Decree provides the electricity tariff payable by buyers for electricity generated by such onshore and offshore wind power projects, with offshore projects being entitled to a higher tariff. It provides that an investor is only permitted to proceed with construction of the wind power project upon meeting the conditions of satisfying construction commencement requirements specified in the laws for construction, and upon entering into a power purchase agreement with an electricity buyer, a connection agreement with a power distributor or transmitter, and having collected a wind measurement report for a period of at least 12 consecutive months.
