Amending Certain Provisions and Supplementing the Competitive Selection Process in the Procurement by Distribution Utilities of Power Supply Agreement for the Captive Market, Department of Energy Department Circular No. DC 2021-09-0030 (Philippines)

The Circular applies to all distribution utilities and power suppliers who enter into a contract, otherwise known as a Power Supply Agreement (PSA), for the procurement of electric power supply for the consumers. All PSAs are required to undergo Competitive Selection Process, wherein a supplier is chosen through the conduct of a transparent and competitive bidding or alternative mode of procurement undertaken by the distribution utility. As an exception, alternative modes of procurement may be resorted to exclusively for new technologies as described in the Circular. These alternative modes refer to an unsolicited proposal from a power supplier and may be subjected to a competitive challenge, or a process wherein other power suppliers may tender an offer.
