Act on Promoting the Utilization of Sea Areas for the Development of Marine Renewable Energy Power Generation Facilities, Act No. 89 of 2018 (Japan)
The Act requires that the area of the sea designated for the development of marine renewable energy power generation facilities must be utilized in accordance with the responsibilities mandated by law on and upon close collaboration among the State, relevant local governments, business operators of marine renewable energy power generation and other related parties.
It is the Minister of Economy, Trade and Industry, and the Minister of Land, Infrastructure, Transport and Tourism which can designate the promotion zones for the development of marine renewable energy power generation facilities.
It further provides for the rules on the permission for exclusive occupancy and use of sea areas within the promotion zones for the development of marine renewable energy power generation facilities, process of certification for such exclusive occupancy through public bidding and the prohibited acts in the promotion zones, among others.
