Act on Prohibition of Private Monopolization and Maintenance of Fair Trade, Act No. 54 of 1947 (Japan)
The Act defines and prohibits private monopolization and unreasonable restraint of trade. It empowers the Fair Trade Commission to order any relevant enterprise to cease and desist from any activities relating to private monopolization or unreasonable restraint of trade, pay a surcharge or transfer an enterprise's business, or to take any other measures necessary to restore competition, pursuant to the provisions of the Act. It also enumerates and defines the rules applicable to trade associations, as well as the prohibited acts which constitute as monopolistic situations and unfair trade practices.
