Ozone Layer Protection Regulations, 2006 (Samoa)
The Ozone Layer Protection Regulations of 2006 of Samoa regulate the supply, purchase and handling of controlled substances, making it unlawful for any person other than authorized supplier to import, export, sell, offer for sale or distribute a controlled substance. Controlled Substances are those substances defined as such under the Montreal Protocol on Substances that Deplete the Ozone Layer. The Regulations authorize the issuance of licenses and permits for handling of Controlled Substances, provided the minimum requirements indicated in the Regulations are met. However, the Regulations specifically declare that use of portable halon fire-extinguishers is unlawful.
Moreover, they declare the following goods as prohibited:
- Dry-cleaning machine that contains or is designed to use a controlled substance as a solvent
- Any aerosol spray that contains a controlled substance other than methyl bromide
- Any plastic foam, or any goods that contain plastic foam containing a controlled substance
- Any dehumidifier, refrigerator, freezer, air-conditioner, supermarket display case, heat pump and water cooler that contains a controlled substance
It further provides for its enforcement and penalties including the forfeiture and seizure of substances and goods in violation of the Regulations. The Regulations further define offenses and imposed penalties for such violations.
