Implementing Rules and Regulations of the Telecommuting Act, Department of Labor and Employment Department Order No. 202, Series of 2019 (Philippines)

The Implementing Rules and Regulations laid down the provisions of the telecommuting agreement which shall be mutually agreed upon by the employer and employee including eligibility, applicable code of conduct and performance evaluation and assessment, and appropriate alternative workplaces, among others. 

They also require that telecommuting employees shall be covered by the same set of rules in the existing collective bargaining agreement, if applicable. If there are differences in interpretation and implementation, these shall be considered as grievances to be resolved under the applicable grievance mechanism of the company. If there is no applicable grievance mechanism or the same is inadequate, the same shall be referred for conciliation and mediation to the Department of Labor and Employment.
